The score of the report

The score of this report is to analyze the situation concerning two employees of the company using the knowledge of legal boundaries.

The target audience

This report is intended to Mrs. Stine, my manager.

The supporting information

HR manager has the record of the dialogue between corporate sales male supervisor Frank and young female sales professional Mary. It was written from the words of the last one. Besides, HR has the additional information about male supervisor who was known for flirting with female sales associates before.

Analysis of the supporting information

As it seen from the dialogue, the actions of Frank can be considered as sexual harassment.

The definition of Paludi and Barickman tells that

“Sexual harassment is intimidation, bullying or coercion of a sexual nature, or the unwelcome or inappropriate promise of rewards in exchange for sexual favors.(Paludi, Barickman, 1991)” First of all, Frank shouldn’t invite Mary for dinner during working hours. However, this invite isn’t a break, and the problem is in Frank’s hints to the intimacy between Mary and Mr. Miller. Besides, Frank promised to sign off her expense account in exchange to the dinner with him and possible intimacy.

“You might get in trouble on this expense account, and if you want me to sign off on it, you are going to have to give me a reason.”

This can be treated as intimidation and inappropriate promise of rewards, besides, it is misfeasance.

Solution

Frank should face severe reprimand and warning, besides, he should be recommended to stop conversation with Mary on themes unrelated with their job. HR should mention that in the case of new complaints on Frank’s behavior he can be fined or even fired.
